1. About SoulAI
These Terms of Service (“Terms”) govern your use of SoulAI, including the website at soulai.best, related mobile applications (including Android), and other SoulAI services that link to these Terms (together, the “Service”).
SoulAI is a Dutch sole proprietorship operating under the trade name SoulAI, registered in the Netherlands under KVK number 91394066.

SoulAI is presented publicly under its own brand and trade name.
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. Eligibility and accounts
You must be at least 18 years old to create or use a SoulAI account. The standard SoulAI Service (including the Google Play app) is for adults aged 18 and over.
Standard SoulAI is a romantic / flirty AI companion experience. It does not include explicit Adult Mode content, explicit Adult media, or Adult AI routing. Those Adult features, where offered, belong only to the separate SoulAI Adult web/PWA experience (see Section 20 and the SoulAI Adult Terms).
You must be able to form a binding contract under applicable law to use the Service. You are responsible for the accuracy of the information you provide and for keeping your sign-in methods secure.
SoulAI may offer sign-in with Google and/or email one-time codes, depending on which methods are enabled. You must not share your account or authentication codes with others.
Where the product asks you to confirm that you are 18 or older, that confirmation is a self-attestation of eligibility only. It is not Didit age verification, not Adult Access verification, and not permission to use Adult Mode or explicit Adult media/chat. Ordinary SoulAI does not require Didit verification unless a specific Adult feature flow separately requires it.
Legal pages such as these Terms, the Privacy Policy, and Delete account may remain publicly readable without an account.
3. AI companions and generated content
SoulAI companions are artificial, fictional AI characters. They are not humans, not real people you are dating, and not conscious beings. Character names, personalities, images, and stories are creative product features.
Companion messages, images, and other outputs may be generated by artificial intelligence systems. AI responses may be inaccurate, incomplete, inconsistent, unexpected, repetitive, or offensive. SoulAI does not promise that a character will always respond exactly as expected or in a particular style.
Do not treat companion output as professional advice of any kind (including medical, mental-health, legal, financial, or crisis advice). SoulAI is entertainment and companionship software, not a substitute for qualified professionals or emergency services.
4. Acceptable use
You may use SoulAI only in accordance with these Terms, applicable law, and any additional rules shown in the product. You must not:
- use the Service for illegal activity;
- exploit, harm, or attempt to exploit or harm others;
- attempt to bypass security, authentication, entitlement, or access controls;
- use malicious automation, scraping, or other abusive tooling that overloads or undermines the Service;
- interfere with or disrupt the Service or other users;
- infringe another person’s intellectual-property, privacy, or other rights;
- impersonate another person or misuse real-person identity material without appropriate rights and permission;
- request, create, or attempt to obtain sexual content involving minors, or characters who are or are presented as under 18;
- attempt to circumvent Adult age-verification or Adult Access safeguards.
SoulAI may refuse, filter, interrupt, or restrict requests that appear to violate these rules. Not every policy issue results in the same response: SoulAI aims to apply proportionate measures based on severity, context, and risk. A minor issue is not treated as an automatic lifetime ban.
5. User content and rights
“User Content” means material you submit to the Service, such as profile text, preference selections, free-text preferences, messages you send, and similar account inputs.
You retain ownership of your User Content to the extent you own it under applicable law. These Terms do not transfer ownership of your private chats or other User Content to SoulAI.
You grant SoulAI a limited, worldwide, non-exclusive licence to host, store, process, transmit, display to you, and otherwise use User Content only as needed to operate, secure, improve the technical functioning of, and provide the Service — including generating AI companion responses and maintaining conversation continuity.
This licence is not a grant of perpetual marketing rights to use your private chats or personal material in advertising. SoulAI does not claim a separate perpetual publicity licence under these Terms.
You are responsible for User Content you submit and for having any rights needed to submit it.
6. AI conversations and limitations
To generate replies, SoulAI must process your messages and related context (such as profile, preferences, memories, and recent chat history) through the Service and, where configured, external AI inference providers. Details of personal-data handling are in the Privacy Policy.
AI-generated output may not be unique. Similar wording or images may be generated for multiple users. Output quality is not guaranteed, and output can contain errors, contradictions, or unwanted material. These Terms do not make copyright-ownership guarantees about AI-generated material.
7. Safety and prohibited use
SoulAI uses safety and content controls intended to reduce harmful or illegal misuse. Those controls are not perfect and may over-block or under-block in some cases.
Strictly prohibited examples include sexual content involving minors; attempts to age down an adult character into a minor in a sexual context; sexual exploitation or trafficking content; non-consensual sexual abuse content where prohibited by law; sexual use of a real person’s likeness without appropriate rights; and attempts to circumvent safety or age-assurance systems.
If you are in crisis or need urgent help, contact local emergency services or an appropriate crisis resource. SoulAI companions are not crisis responders.
8. Subscriptions and paid features
SoulAI may offer free access and paid plans or entitlement features. The product currently models plan tiers such as free and paid entitlement levels, and may later support store billing (for example Google Play) where integrated.
Where a paid feature is offered, the applicable price, billing frequency, renewal terms, cancellation method, and any required consumer information will be shown at or before purchase. Specific prices and billing rules are not stated in these Terms until paid checkout is live.
9. Cancellations and consumer rights
Nothing in these Terms asks you to waive mandatory consumer rights that apply to you under applicable law, including any withdrawal, cooling-off, or refund rights that cannot lawfully be excluded.
Specific cancellation and refund mechanics depend on how a purchase is made (for example in-app via an app store, or another checkout method) and on mandatory law. Those mechanics will be stated in the purchase flow and related notices when paid features are available.
These Terms do not state that “all payments are non-refundable” or that purchasing automatically waives withdrawal rights.
10. Availability and changes to the service
SoulAI may change, suspend, or discontinue features as the product evolves. The Service may be unavailable from time to time due to maintenance, outages, capacity limits, provider issues, or legal requirements.
Features, characters, limits, and availability can vary by platform, region, account status, and product rollout. SoulAI does not guarantee uninterrupted or error-free operation.
11. Account suspension and termination
SoulAI may temporarily restrict or suspend access where reasonably necessary for serious Terms violations, safety abuse, fraud or security issues, legal obligations, or attempts to bypass access controls.
Temporary restriction is different from account termination. SoulAI aims to use proportionate measures. Permanent termination or deletion is reserved for more serious or repeated problems, or where required by law or safety.
You may request deletion of your account through the available deletion path, including the public Delete account information page. Depending on product rollout, some public forms may still be informational until the live deletion workflow is fully activated.
These Terms do not use “we may delete your account for any reason at any time” language.
12. Intellectual property
SoulAI and its licensors own the Service software, branding, character designs, and other SoulAI materials (excluding your User Content). You may not copy, modify, distribute, or create derivative works from SoulAI materials except as allowed by these Terms or mandatory law.
Feedback you voluntarily send about the Service may be used by SoulAI to improve the product without an obligation to compensate you.
13. Privacy
How SoulAI processes personal information is described in the Privacy Policy. These Terms do not replace that policy.
Accepting these Terms (or Adult Terms) is a contractual step. It is not the same thing as GDPR consent for a specific personal-data processing activity. Where GDPR consent or another Article 9 condition is needed for sensitive data, that issue is handled in the Privacy Policy and related product notices — not by treating Terms acceptance as privacy consent.
14. Disclaimers
To the fullest extent permitted by mandatory law, the Service is provided on an “as available” basis. SoulAI does not warrant that companion behaviour, AI output, matches, or availability will meet every expectation.
Nothing in these Terms excludes or limits rights or remedies that cannot be excluded or limited under applicable consumer law.
15. Liability
SoulAI is responsible for foreseeable damage caused by a failure to meet obligations that cannot lawfully be excluded. SoulAI does not attempt to exclude liability for death or personal injury caused by negligence, fraud, or other liability that applicable law does not allow to be limited.
Subject to those mandatory protections, SoulAI is not liable for losses that were not reasonably foreseeable, or for losses caused primarily by your misuse of the Service or by events outside SoulAI’s reasonable control (including third-party AI-provider outages).
16. Indemnity
If you misuse the Service or submit User Content that unlawfully harms another person or SoulAI, you may be responsible for the resulting claims to the extent permitted by applicable law.
17. Changes to these Terms
SoulAI may update these Terms from time to time. Material changes will be indicated by updating the version and/or last-updated date on this page. Where required by law or product design, SoulAI may provide additional notice.
The current version identifier is 2026-08-15.
18. Governing law and disputes
SoulAI is established in the Netherlands. Nothing in these Terms limits mandatory consumer rights that apply to you under the law of your country of residence.

20. Additional terms for SoulAI Adult
SoulAI Adult is a separate 18+ web and progressive web app (PWA) experience. Additional rules for Adult eligibility, Adult content, verification, and related use are set out in the SoulAI Adult Terms.
If there is a conflict on a topic specific to SoulAI Adult, the Adult Terms control for that Adult-specific topic. Topics not covered there remain governed by these Terms and the Privacy Policy, as applicable.
Like the rest of SoulAI, SoulAI Adult is strictly for persons aged 18 or older. Stronger Adult age verification (for example through an approved provider such as Didit) may be required before restricted Adult features. Explicit Adult functionality described in the Adult Terms is not offered through the Google Play version of SoulAI.
Accepting Adult Terms, self-attesting 18+, or completing age verification does not by itself guarantee that Adult Mode or Adult capabilities are available. Adult Mode may remain disabled for product or compliance reasons.
